These Terms of Use (the "Terms") are a binding agreement between ALFÀ inc ("ALFÀ," "we," "us," or "our") and you ("you" or "your"). These Terms govern your access to and use of our websites, mobile applications, and any related services that link to or reference these Terms (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the consent of your parent or legal guardian who agrees to be bound by these Terms.

2) Privacy

3) Accounts

You may need to create an account to access certain features. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for any activities under your account. Notify us immediately of any unauthorized use at help@alfabasics.com.

4) Purchases; Pricing; Payments

By placing an order through the Services, you make an offer to purchase the products listed in your order, subject to these Terms. We may accept or reject any order in our sole discretion. Prices, product descriptions, and availability are subject to change without notice. We may correct errors or inaccuracies at any time.

You authorize us (and our payment processors) to charge your selected payment method for the total amount of your order, including applicable taxes, shipping, and fees. All sales are subject to our Shipping and Return policies referenced on the Services.

5) Shipping; Risk of Loss

Title and risk of loss for items pass to you upon our delivery of the items to the carrier. Delivery dates are estimates and not guaranteed. We are not liable for delays beyond our reasonable control.

6) Returns & Exchanges

Returns and exchanges (if offered) are governed by our Return Policy posted on the Services. To start a return or exchange, follow the instructions in that policy or contact help@alfabasics.com.

7) Subscriptions & Recurring Payments (If Applicable)

If you enroll in any subscription program, you authorize recurring charges to your payment method at the frequency disclosed at enrollment until you cancel. You can cancel future charges per the instructions provided in your account or by contacting help@alfabasics.com before the next billing date.

8) Promotions, Discounts & Gift Cards

Promotions and discounts are subject to the terms stated at the time they are offered and may not be combined unless expressly permitted. We may modify or discontinue any promotion at any time. Gift cards are nonrefundable except as required by law.

9) User Content; Reviews

You may submit reviews, photos, comments, and other content ("User Content"). You grant ALFÀ a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to host, use, reproduce, modify, publish, translate, distribute, and display your User Content in any media for operating, marketing, and improving the Services. You represent and warrant that you own or control all rights in your User Content and that it does not violate any law or third-party rights.

We may remove or refuse to display any User Content at our discretion.

10) Acceptable Use

You agree not to:

  • use the Services for any unlawful purpose;

  • infringe or violate intellectual property, privacy, or other rights of others;

  • upload viruses or malicious code or interfere with the security or operation of the Services;

  • attempt to gain unauthorized access to the Services or related systems;

  • use any scraping, data mining, robots, or similar data-gathering tools without our prior written consent;

  • misrepresent your identity or affiliation.

11) Intellectual Property

The Services, including all content, text, graphics, logos, icons, images, designs, software, and other materials, are owned by ALFÀ inc or our licensors and are protected by copyright, trademark, and other laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, create derivative works, publicly display, or otherwise use any portion of the Services without our prior written consent.

All trademarks, service marks, and trade names, including ALFÀ and related marks, are the property of ALFÀ inc or their respective owners. No license or right is granted by implication, estoppel, or otherwise.

12) Third-Party Links & Services

The Services may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third-party site or service. Access them at your own risk.

13) Product Information; Color & Sizing

We try to display product features accurately, including colors and sizing, but your device and display settings may affect what you see. Measurements are approximate. Minor variations may occur.

14) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ALFÀ INC OR OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO ALFÀ INC FOR THE APPLICABLE PRODUCT(S) OR, IF NO PURCHASE WAS MADE, ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless ALFÀ inc and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

17) Governing Law; Venue

These Terms are governed by the laws of the United States and the laws of the state in which ALFÀ inc is incorporated, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in that state for any disputes that are not subject to arbitration.

18) Dispute Resolution; Arbitration; Class Action Waiver (If Permitted by Law)

To the extent allowed by law, any dispute arising from or relating to these Terms or the Services will be resolved through binding individual arbitration, and you waive your right to participate in a class action or class-wide arbitration. You and ALFÀ inc agree to attempt to resolve disputes informally first by contacting help@alfabasics.com. If the dispute is not resolved within 60 days, either party may commence arbitration before a recognized arbitration provider in the state of ALFÀ inc's incorporation. This section does not apply where prohibited by law.

19) Termination

We may suspend or terminate your access to the Services at any time for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.

20) Changes to the Services and Terms

We may update the Services and these Terms from time to time. When we do, we will revise the "Effective Date" above. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
